1. Acceptance of Terms

By engaging Sakshi's Creative Interiors (referred to as "we," "us," or "our") for interior design services, you ("Client") agree to be bound by these Terms of Service. These terms constitute a legally binding agreement under Indian law, specifically governed by the Indian Contract Act, 1872 and Consumer Protection Act, 2019.

  • Interior design consultation and planning
  • Space planning and layout design
  • 3D visualization and mood boards
  • Material and furniture selection
  • Project coordination and supervision

  • Residential interior design
  • Commercial space design
  • Office interior planning
  • Hospitality design solutions
  • Renovation and remodeling

3. Payment Terms

Consultation Fees

  • Initial consultation: As agreed upon booking
  • Site visit charges: Applicable for locations outside Bengaluru
  • Consultation fees are non-refundable
  • Payment due before service delivery

Project Payment Structure

  • 30% Advance: Upon project confirmation
  • 50% Progress: At 50% project completion
  • 20% Final: Upon project completion

Payment Methods & Compliance

  • All payments subject to applicable GST as per Indian tax laws
  • Payments accepted via bank transfer, UPI, or cheque
  • Late payment charges: 2% per month on overdue amounts
  • All transactions comply with RBI guidelines
  • Tax invoices provided as per GST regulations

4. Client Responsibilities

Site Access & Preparation

  • Provide safe and timely access to premises
  • Ensure necessary statutory approvals
  • Provide accurate site dimensions and details
  • Clear site of personal belongings as required

Decision Making

  • Timely approval of designs and materials
  • Clear communication of preferences
  • Adherence to agreed timelines
  • Final decisions within specified timeframes

Legal Compliance

  • Obtain necessary building permits
  • Ensure compliance with local bylaws
  • Provide property ownership documents
  • Handle society/neighbor approvals

Financial Obligations

  • Timely payment as per agreed schedule
  • Bear additional costs for scope changes
  • Handle utility connections and charges
  • Provide valid PAN and address proof

5. Warranties & Limitations

Our Warranties

  • Design Quality: Professional design standards and industry best practices
  • Material Authenticity: Genuine materials as specified in agreements
  • Workmanship: 6-month warranty on execution work (excluding wear and tear)
  • Project Delivery: Timely completion as per agreed schedule

Limitations of Liability

  • Not liable for delays due to force majeure events
  • Third-party vendor defects covered by respective warranties
  • No liability for pre-existing structural issues
  • Maximum liability limited to contract value
  • No liability for consequential or indirect damages

6. Intellectual Property Rights

Our Rights

  • Design concepts and creative elements
  • Portfolio usage rights for marketing
  • Methodologies and design processes
  • Right to publish project photographs

Client Rights

  • Use of delivered designs for intended purpose
  • Ownership of physical installations
  • Right to modify after completion (at own risk)
  • Privacy of personal spaces and information

7. Cancellation & Refund Policy

Cancellation by Client

  • Before Project Commencement: 70% refund of advance payment (excluding consultation fees)
  • After Project Commencement: Refund based on completed work, minimum 30% retention
  • After 50% Completion: No refund, client pays for completed work

Cancellation by Us

We reserve the right to cancel projects in case of:

  • Non-payment of dues beyond 30 days
  • Breach of contract terms by client
  • Safety concerns or legal compliance issues
  • Force majeure events extending beyond 60 days

In such cases, refund will be calculated based on work completed and materials procured.

8. Dispute Resolution

Disputes shall be resolved through the following steps:

  1. Direct Resolution: Initial attempt through direct communication and negotiation
  2. Mediation: Mediation through industry professionals or consumer forums
  3. Legal Action: Courts in Bengaluru, Karnataka shall have exclusive jurisdiction

Governing Law: These terms are governed by Indian law, including the Indian Contract Act, 1872, Consumer Protection Act, 2019, and other applicable regulations.

Continued engagement with our services after such modifications constitutes acceptance of the updated terms. For ongoing projects, existing terms remain valid unless mutually agreed otherwise.
